Believer Program — Engineering-Prototype Loan Terms & Conditions

1. Purpose
Worldex Lab, Inc. (“Dex,” “we,” “our”) operates the Believer Program to obtain real-world feedback on an engineering-prototype of the Dex learning camera (“Prototype”) before mass production of the fully certified Founding-edition Dex (“Retail Unit”). These Terms govern your family’s voluntary participation.
2. Eligibility & Enrollment
- Invite-only. Up to 100 families in the United States are selected at Dex’s sole discretion.
- Adult acceptance. The primary contact (“Participant,” “you”) must be 18 or older and legally able to enter a contract.
- Opt-in during pre-order. Enrollment occurs by checking the “Join Believer Program” box and accepting these Terms at checkout. No payment is taken for the Prototype. Your pre-order payment applies only to the Retail Unit.
3. Prototype Loan, Ownership & Return

| Return | Participant will ship the Prototype (and all accessories) using Dex’s prepaid label or allow Dex to retrieve or remotely disable it. |
| Failure to return | Dex may charge the Retail-Unit MSRP or withhold shipment of the Retail Unit until the Prototype is received or confirmed destroyed. |
4. Prototype Status & FCC Notice
- Not yet certified. The Prototype has not been authorized under FCC Part 15/Part 22/24 rules; it is supplied solely for evaluation (§ 2.805 FCC Rules).
- Required label. Prototype bears a removable label stating:
“This device has not been authorized as required by the rules of the Federal Communications Commission. This device is for evaluation only.”
- Controlled radios. Prototype may be remotely updated, disabled, or limited to carrier-approved SIM/eSIM profiles at Dex’s discretion.
5. Participant Obligations
- Normal home use. Use the Prototype in a non-commercial, indoor environment within the U.S. Only the Participant’s household may handle it.
- Safety & supervision. Provide age-appropriate supervision of children; comply with all warnings in the Quick-Start Guide.
- Feedback. Provide at least three written or verbal feedback points during the loan period.
- Optional media. Photos/videos of the Prototype in use are welcome, strictly for Dex internal R&D unless you grant additional permission.
- Confidentiality. Treat Prototype hardware, software, and documentation as Dex confidential information; do not publish teardown photos, benchmark data, or reverse-engineer.
6. Data & Privacy
- Data collected. Prototype may upload diagnostic logs, usage statistics, and sample interaction snippets (voice, image, motion data) to Dex servers.
- COPPA compliance. Dex already obtains verifiable parental consent before collecting any child-identifying data and will present a child-friendly privacy notice on-device. The prototype is fully COPPA compliant.
- Data retention. By default, Dex maintains zero data retention policy unless you opt into cloud story otherwise. See Privacy Notice for details. Qualitative prototype feedback data will be stored for R&D for up to 12 months, then anonymized or deleted.
- Privacy Policy. All data handling follows the Dex Privacy Notice (link).
7. Software Updates & Remote Actions
Dex may remotely: (a) install firmware/software updates, (b) wipe stored content, (c) suspend network connectivity, or (d) brick the Prototype for security or recall.
8. Warranty Disclaimer
Prototype is provided “AS IS,” with no express or implied warranties, including merchantability, fitness for a particular purpose, or non-infringement. Some jurisdictions do not allow exclusion of implied warranties; exclusions apply to the fullest extent permitted.
9. Limitation of Liability
To the maximum extent allowed by law, Dex’s total liability arising out of or related to these Terms or the Prototype will not exceed US $100. Dex will not be liable for any indirect, incidental, or consequential damages.
10. Termination
Dex may terminate participation at any time upon written notice (including email). Upon termination you must return or destroy the Prototype immediately.
11. General
- Governing law. California law (excluding conflict-of-law rules).
- Dispute resolution. Any dispute will be resolved by binding arbitration in San Francisco County under the JAMS Streamlined Rules.
- No waiver. Failure to enforce any provision is not a waiver.
- Severability. If a provision is held unenforceable, the remainder stays in effect.
- Entire agreement. These Terms plus the Dex Privacy Notice constitute the full agreement regarding the Prototype loan.
By checking the “Join Believer Program” box or otherwise accepting these Terms, you acknowledge that you have read, understood, and agree to be bound by them.
